This License Agreement is a legal agreement between you (Web Site visitor) and Management of Appropriate Knowledge in Development Assistance, Inc. (referred to as MAKDA). Please take a moment and read this Agreement before surfing, downloading, or submitting an online form on the Web Site. Use of this Web Site means (a) you agree to all terms and conditions in this Agreement; and (b) you are at a legal age to enter into legal binding contracts under applicable law. By using this Web Site, all users do hereby agree that they have read this Agreement, understands it completely, agree to it and accept all terms and conditions contained herein. If you do not agree to any of the terms set forth herein, you may not use this Web Site.
Web Site Limitation:
Makda grants its visitors a nonexclusive, irrevocable right to browse the Web Site with the following conditions; (a) you do not copy, reverse engineer, and attempt to discover the source code; and/or (b) you do not create a derivative work under a new name.
You agree to:
(a) provide current and accurate information to the best of your knowledge when submitting a form or contacting us;
(b) provide information that shall not be fraudulent, counterfeit or misleading;
(c) provide information that does not violate copyright laws, trademarks, trade secret or other proprietary information;
(d) provide information that does not violate any law, statute, ordinance or regulations of the United States of America;
(e) not provide content of obscene nature, including adult content, child pornography, derogatory wording;
(f) provide information that does not contain any Trojan horses, viruses, worms or any computer program that can damage the receiving party’s computer;
(g) shall not create liability for us in part or whole with our ISP, business associates, affiliates or users. As we strive to protect your information, in return we expect that, you also protect your information and that you take the responsibility to enter “Your Information” from a virus free computer.
Changes to this Agreement:
For any reason, from time to time, only MAKDA may, amend, change and update this Agreement and at its discretion without any prior notice or liability. However, it is your responsibility as a Web Site visitor to review the “Terms and Services” (this Agreement) each time you visit the Web Site. You may compare the last modified date of this agreement, which will be published at the beginning of this agreement.
You as a Web Site visitor agree not to hold MAKDA, its agents, employees, partners or business associates liable for any advice, which originated through the Web Site. You agree to indemnify Makda and hold them harmless from and against any expense (legal fees, traveling expense or other expenses), loss or claim by a third party arising out of (a) submitted information through email or web form; (b) any information and/or advice offered by any parties other than Makda;
You authorize MAKDA and its business associates to: (a) to establish a communication channel with you; (b) respond to you either by email, phone or other means of communications. MAKDA may refuse to contact you if it feels the information provided is fraudulent or incomplete or it is considered as conflicting with MAKDA’s business operation or beliefs.
You are prohibited from: (a) violating or attempting to violate the privacy of other visitors; (b) accessing data stored on our servers without authorization; (c) scanning or testing the vulnerability of our web servers, applications or network; (d) flooding our mail server; (e) forging or sniffing any TCP/IP packet or any part of a data exchange; (f) endangering the security of the System by any means. You understand that a violation may result in civil and/or criminal liability and that MAKDA may take any legal action they deem necessary for any financial damages that may occur.
The Web Site is governed by MAKDA from Austin, TX, United States of America. Any controversy or claim arising out of this Agreement or out of our Web Site or services shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. The arbitration will be before a single arbitrator on individual bases. The place of arbitration will be Austin, Texas, United States of America and matters must be commenced within six (6) months after the claim or cause of action arises. After six months, the claim or cause of action is forever barred, regardless of any statute or law to the contrary.
The Web Site is provided “As is”. You may use the Web Site on your own risk. MAKDA take no warranty of the information provided on the Web Site. The Internet is not secure and any communication sent to MAKDA may be interrupted by sniffing packets installed on your computer or systems you are using to browse the website. There is no warranty that the Web Site will be compatible with all the devices and browsers you use to surf the internet. The Web Site contains information which is protected by the domestic and international laws of copyright, patents or other proprietary rights and laws. This Agreement is subject to change without notice.
